1. About these terms

These Terms and Conditions ("Terms") govern your use of www.rachelrubinmd.com and any pages, forms, newsletters, and text or email communications that link to these Terms (together, the "Site"). The Site is operated by Rachel Rubin MD PLLC ("Rachel Rubin MD," "the practice," "we," "us," or "our"), 4416 East West Highway, Suite 410, Bethesda, MD 20814.

By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

These Terms cover the website only. If you are a patient of the practice, your care is governed by the separate consent forms, financial agreements, and practice policies you receive as a patient, and your medical information is governed by our Notice of Privacy Practices.

2. Educational information only — not medical advice

The Site shares information about sexual medicine, urology, menopause, and related topics as part of our commitment to education and advocacy. Everything on the Site, including blog posts, videos, infographics, newsletters, and links to research and media, is provided for general educational purposes only.

Content on the Site is not medical advice, diagnosis, or treatment, and it is not a substitute for care from a qualified clinician who knows your history. Do not disregard professional medical advice or delay seeking it because of something you read or watched on the Site. Always talk with your own doctor before starting, changing, or stopping any medication or treatment.

Medical knowledge changes. We work to keep content accurate and current, but we do not guarantee that any content is complete, up to date, or right for your situation.

3. No doctor-patient relationship

Using the Site, submitting a form, joining an interest list or waitlist, subscribing to the newsletter, purchasing a course, or sending us an email, text, or social media message does not create a doctor-patient relationship with Rachel Rubin MD or any of its doctors. A doctor-patient relationship begins only after you have been accepted as a patient, completed the practice's registration and consent process, and been seen by one of our doctors.

Submitting a new patient inquiry does not guarantee an appointment. Availability varies by doctor and location.

4. Emergencies

The Site, our forms, our email, and our text line are not monitored for emergencies. If you think you are having a medical or mental health emergency, call 911 or go to the nearest emergency room.

5. Who may use the Site

The Site is intended for adults age 18 and older in the United States. The Site discusses sexual health in frank, clinical terms. By using the Site, you confirm that you are at least 18 years old.

6. Forms, inquiries, and appointment requests

The Site includes forms for general inquiries, new patient interest, course support, media and speaking requests, job applications, and newsletter signup. When you submit a form, you agree to give accurate information and to submit only your own information, or information you are authorized to share.

Website forms and ordinary email are not designed for sharing detailed medical information. Please keep health details in forms to the minimum needed for us to route your request. Established patients should use the patient portal for clinical questions, refill requests, and scheduling.

We respond to inquiries during business hours and as staffing allows. A form submission is a request, not a confirmed appointment.

7. Patient portal and third-party services

The Site links to services operated by other companies, including our patient portal, our course platform, and social media and video channels. Those services have their own terms and privacy policies, which apply when you use them. We are not responsible for the content, security, or availability of services we do not operate.

If you are a patient, you are responsible for keeping your portal login confidential and for telling us promptly if you believe someone else has accessed your account.

8. Courses, infographics, and other purchases

Educational courses and downloadable materials are sold through a third-party course platform. Purchases are subject to the price, access period, and refund terms shown at checkout, along with the platform's own terms.

Courses and materials are educational. They do not provide individual medical advice, and unless a course states otherwise, they do not confer continuing education credit or any certification. Course access is licensed to the individual purchaser for personal or internal professional education and may not be shared, resold, recorded, or redistributed.

9. Text messaging terms

If you provide a mobile number and opt in, Rachel Rubin MD may send you text messages related to your inquiry or your care, such as responses to questions you sent us, scheduling and appointment reminders, intake and paperwork follow-up, and practice updates.

  • Consent. You opt in by checking the consent box on a form, by texting us first, or by giving consent to our staff. Consent to receive texts is not a condition of becoming a patient or of buying anything.

  • Frequency. Message frequency varies based on your interaction with the practice.

  • Cost. Message and data rates may apply, depending on your mobile plan.

  • Opt out. Reply STOP to any message to stop receiving texts. You will get one confirmation message and no further texts unless you opt in again.

  • Help. Reply HELP for help, or call (202) 888-6731 or email [CONTACT EMAIL].

  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

  • Privacy. We do not sell or share mobile numbers or text messaging consent with third parties or affiliates for their marketing purposes. See our Privacy Policy.

Text messaging is not encrypted and is not a secure way to discuss detailed medical information. Our text line is staffed during business hours only and is never to be used for emergencies or urgent clinical concerns.

10. Email and newsletter

If you subscribe to our newsletter, we will send you educational content, practice news, and occasional announcements about courses, events, research, and advocacy. You can unsubscribe at any time using the link at the bottom of any email. Newsletter content is educational and is not medical advice.

11. Intellectual property

The Site and its content, including text, graphics, logos, photographs, videos, infographics, course materials, and the Rachel Rubin MD name and logo, are owned by Rachel Rubin MD PLLC or its licensors and are protected by copyright, trademark, and other laws.

We want this information to reach people. You may view, download, and share links to Site content for personal, non-commercial, educational use, as long as you credit Rachel Rubin MD and do not alter the content. Any other use, including republishing, selling, using content in paid programs, or using our names, likenesses, or logos to suggest endorsement, requires our written permission. Send permission, media, and speaking requests through the contact form.

12. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or to harass, threaten, or impersonate anyone;

  • submit false information or information about another person without authorization;

  • attempt to gain unauthorized access to the Site, our systems, or the patient portal;

  • interfere with the Site's operation, or introduce malware or harmful code;

  • scrape, crawl, or harvest content or data from the Site by automated means, or use Site content to train or develop artificial intelligence or machine learning tools, without our written permission; or

  • use the Site to send unsolicited advertising or solicitations.

13. Third-party links, products, and mentions

The Site links to outside websites, research, media coverage, and resources, and may mention specific medications, devices, or products. These links and mentions are for information only. They are not endorsements, and we do not control and are not responsible for outside content.

Our doctors may have consulting, speaking, research, or advisory relationships with companies in the health field. Where a relationship is relevant to content on the Site, we aim to disclose it.

14. Disclaimers

The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components. You use the Site and rely on its content at your own risk.

15. Limitation of liability

To the fullest extent permitted by law, Rachel Rubin MD PLLC and its owners, doctors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from or related to your use of the Site or reliance on its content. 

Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, and nothing in this section applies to professional medical services provided to patients of the practice.

16. Indemnification

You agree to indemnify and hold harmless Rachel Rubin MD PLLC and its owners, doctors, employees, and contractors from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. Any dispute related to the Site or these Terms will be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to the jurisdiction of those courts.

18. Changes, termination, and general terms

We may update these Terms from time to time. The effective date at the top shows when they were last revised, and your continued use of the Site after a change means you accept the updated Terms. We may change, suspend, or discontinue any part of the Site, or restrict access to it, at any time.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Site.
